Terms & Conditions of Toshiba’s Reliability Refund Guarantee
Promotion
("these Promotion Terms")
Version 4.0, 14/01/10
This Promotion is open to end-users,
businesses and organisations, who purchase qualifying Toshiba
business laptops in the Promotion period. All cheques will be made
payable to the end-user, business or organisation responsible for
purchasing the laptop.

Promotion
-
Subject to these Promotion Terms, if you
purchase a qualifying Toshiba laptop within the Promotion term,
and it develops a technical fault within one (1)
year of purchase*, we will repair or replace the laptop
free-of-charge, and refund the purchase price of the laptop to you
(“this Promotion”).

This Promotion will open on 1st
January 2010 and close at midnight on 31st March 2010
(“the Promotion Term”) and will apply only to qualifying
Toshiba laptops purchased within the Promotion Term.

The closing date for you to register for
this Promotion will be 7 days after the date of invoice. For
example, if the invoice for your qualifying Toshiba laptop
is dated 1st January 2010, you must register for this
Promotion on or before 8th January 2010.

You must register the laptop in
accordance with Section C below within seven (7) days of the date
of invoice If you purchase the laptop on the
final day of this Promotion (i.e. 31st March 2010), you
must register the laptop on or before 7th April 2010.
If you do not do this, you cannot claim under this Promotion.

If you believe that the laptop has developed
a technical fault within one (1) year of purchase*, you must
follow the claims process set out in Section D
below otherwise your claim will be invalidated.
*Or within three years of purchase if you have
a Toshiba laptop with three-year warranty, or if you have purchased
Toshiba’s two-year extended warranty with a laptop with a one-year
warranty.

Scope & restrictions
Please note the following limitations
and exclusions applying to this Promotion:

This Promotion
is:

Open only to end-users, businesses
and organisations in the United Kingdom and the Republic of Ireland. |

Open only to end-users, businesses and organisations, who
must be the owners of the laptops to register them for the
Promotion. This Promotion is
not open to distributors, resellers, retailers, e-sellers
and other sellers and suppliers of Toshiba laptops.. |

 |
Applicable only to qualifying
Toshiba Satellite Pro, Tecra and Portégé laptops. These are
the only qualifying Toshiba laptops under this Promotion
(visit
www.toshiba.co.uk/reliabilityrefund for qualifying
models), and this Promotion does not apply to any
accessories, peripherals, software, options
or other applications purchased with or for the laptop. |

Limited to one (1) claim per laptop.
This Promotion will not apply to laptops repaired or
replaced under this Promotion. |

This Promotion does not apply to laptops
which are or have been the subject of a product recall.

Registering
To register the laptop:
-
Log-on to Toshiba’s website at
www.toshiba.co.uk/reliabilityrefund
within seven (7) days of invoice date. Click on the ‘Register your new laptop
here’ link.

Register the laptop by fully completing the
on-line registration process, and print the resulting
Toshiba Reliability Refund Guarantee Certificate of Registration
(“the Certificate”).

Please ensure that you are able to
print from the laptop before registering it for the Promotion.
You have only one (1) opportunity to print the Certificate, and
you cannot make a claim unless you have the original printed
Certificate.

If you purchase Toshiba’s 2-year extended
warranty, you must purchase and register the laptop and the
extended warranty at the same time.
-
Only the end-users, businesses or
organisations, who own the laptops may register for this Promotion
– resellers cannot register on behalf of their customers.
Please note that registration for this
Promotion and registration for Toshiba warranty are different
processes, and that registering for warranty will not register you
for this Promotion.

Claiming
-
Provided that you have registered the laptop in
accordance with Section C above, if you believe that the laptop has
developed a technical fault within one year of purchase*, you must (1)
call 0845 0512187 to find out how you must get the laptop repaired or
replaced, and (2) within twenty-one (21) days of the laptop
being repaired or replaced submit the following documents: These
documents must be received no later than 26 days after being repaired or
replaced.

The original Toshiba
Reliability Refund Guarantee Certificate of Registration, which you should
have printed when you registered the laptop; |

The original proof of purchase,
clearly showing the purchase details of the laptop within the Promotion
Term. This will be returned to you with your
refund; and |

 |
The original repair or
replacement receipt from Toshiba or Toshiba’s Authorised Service Provider,
clearly detailing the nature of your technical fault.
We do advise you to send these documents by recorded delivery and to retain
a copy for your records. |
*Or within three years of purchase if you have a
Toshiba laptop with three-year warranty, or if you have purchased Toshiba’s
two-year extended warranty with a laptop with a one-year warranty.

Toshiba reserves the right to request proof of
identity and proof of address from the claimant before progressing a claim.

You must submit the above documents to Toshiba Laptop
Offer, Dept. No. 8752(09), PO Box 7172, Milton Keynes, MK14 6WG.

Your claim will not be valid unless you first call the
phone number under Section D above. Your claim will not be valid if you have
the laptop repaired or replaced before calling the phone number under
Section D above.

Your application will be verified and (provided that
your application complies with these Promotion Terms) a cheque will be sent
to you within twenty-eight (28) days of receipt of your claim.

Purchase Price means the price paid for the laptop,
excluding delivery charges and the price of any accessories, peripherals,
software, options or other applications purchased with or for the laptop.
VAT is excluded for VAT-registered businesses.

Technical fault means a technical fault with the
physical hardware of the laptop, expressly excluding the following:

Case cracks and broken plastics; |

Display panels containing only a small number
of pixels that have failed; |
| |
 |
Physical damage such as broken keys, smashed
display and liquid spillages; |
| |
 |
Software issues; |
| |
 |
System configuration issues; |
| |
 |
Infection by virus or other malware; |
| |
 |
BIOS updates; |
| |
 |
Mains/power adaptors; |
| |
 |
Battery packs older than one (1) year; |
| |
 |
Damage caused by the end-user, whether
accidental, through misuse or abuse or otherwise; and |
| |
 |
Any other fault or damage which Toshiba
reasonably believes is not a technical fault. |

This Promotion does not apply to (and claims will not
be accepted for) faults or damage caused by external influence, such as
(without limitation) damage caused during transit. If you receive a laptop
that is subject to such faults or damage, you must immediately return it to
your reseller. The replacement laptop that you receive may then be
registered for this Promotion.

DOA (dead on arrival) machines are not covered under
the terms of this Promotion, please contact your retailer/reseller.

Refusing claims
We reserve the right to refuse claims if:
-
At any stage you have not fully complied
with these Promotion Terms, or if a claim is not submitted
strictly in accordance with these Promotion Terms; and
-
The laptop has been deliberately damaged, or
if we have reason to believe that the laptop has been deliberately
damaged. For the avoidance of doubt, we may base such belief on
our internal data and statistics in relation to laptop failure
rates.

Other terms & conditions
-
This Promotion does not affect your
statutory rights.
-
This Promotion is not open to employees of
Toshiba (or their families), to any Toshiba authorised resellers
and distributors (or their employees or families), or to anyone
connected professionally with this Promotion.

Photocopied Certificates, proof of purchase
and repair/replacement receipts will not be accepted. Only
originals will be accepted.
-
We suggest you take a photocopy of your
documents before sending them, we also recommend these documents
are sent by recorded delivery.
-
Toshiba cannot accept any responsibility or
liability for claims or other documents lost, delayed or damaged
in the post. Proof of posting will not be accepted as proof of
receipt.
-
Leased laptops do not qualify for this
Promotion.
-
Cheques will be made payable to the end-user
or business / organisation responsible for purchasing the laptops.
-
Toshiba will be responsible for the cost of
sending the refund to you, but you will be responsible for all
other costs and expenses associated with the claims/refunds
process.
-
Toshiba does not warrant that your access to
or use of the Promotion web site will be uninterrupted, error-free
or virus-free. Neither Toshiba nor its licensors or suppliers will
be responsible or liable for damage or losses caused by hostile
software which may affect or infect your computer equipment or
property, as a result of your browsing or use of the Promotion web
site.

All claim applications will be screened for
validity to ensure that no laptops are or have been returned by
the end-user or businesses /organisation between registration and
claim.

To the maximum extent permitted by applicable law,
in no event will Toshiba be liable for any losses or damages whatsoever
(including direct or indirect damages, loss of business profits, lost
savings or other special, incidental, exemplary or consequential damages
whether for breach of warranty, contract, strict liability, tort or
otherwise) arising out of or in connection with this Promotion.

Failure by Toshiba to enforce any provision
of these Promotion Terms in whole or in part will not constitute a
waiver, or affect Toshiba’s right to require the future
performance in full thereof, nor shall Toshiba’s waiver of any
breach of any provision of these Promotion Terms constitute a
waiver of any subsequent breach or nullify the effectiveness of
any such provision.

If any provision of these Promotion Terms is
be found by any court, tribunal or administrative body of
competent jurisdiction to be illegal, invalid or otherwise
unenforceable, such illegality, invalidity or unenforceability
will not affect the other provisions of these Promotion Terms,
which will remain in full force and effect.

This Promotion and these Promotion Terms
will be governed by and construed in accordance with the laws of
England, and each party irrevocably agrees to submit to the
exclusive jurisdiction of the English courts in relation to all
claims arising out of or in connection with this Promotion and
these Promotion Terms.
